PestFolio Terms of Service

These Terms of Service ("Terms") are an agreement between Sunhaven Labs, Dubai, United Arab Emirates ("we", "us") and the business that signs up for PestFolio ("you", the "Customer"). By creating an account you confirm that you are authorised to accept these Terms for your business.

1. The service

1.1 PestFolio is a web app for pest control businesses. It covers scheduling, AMC contracts, bilingual job sheets and reports, a chemical register, pest control records, a client portal where your clients can view their reports, and insights about your operations (together, the "Service").

1.2 PestFolio is a business tool. It is offered only to businesses, not to consumers.

1.3 We may improve or change features over time. If we remove a feature you rely on in a way that materially reduces the Service, we will tell you in advance where we reasonably can.

2. Free trial

2.1 New accounts start with a free trial of 30 days for up to 3 technicians.

2.2 We do not ask for card or payment details during the trial and we do not charge you anything for it.

2.3 The trial does not turn into a paid plan automatically. When the trial ends, your account is paused unless you choose a paid plan.

2.4 We may end or change trial offers for new sign-ups at any time. This does not shorten a trial that has already started, except under section 9.

3. Paid plans

3.1 Paid plans are only available once we offer them to you and you accept them. Prices are shown on our website or in our offer before you accept.

3.2 Any payment terms, billing period and renewal rules will be shown to you before you subscribe and will form part of these Terms once you accept them.

4. Your account

4.1 You are responsible for your users (owners, office staff and technicians), for keeping login details secure, and for everything done under your account.

4.2 Tell us promptly at support@pestfolio.ae if you believe your account has been accessed without permission.

5. Your data

5.1 You own the data you and your users enter into PestFolio, including client details, contracts, job sheets, reports, photos and chemical records ("Customer Data").

5.2 For personal data in Customer Data (for example your clients' names, addresses and phone numbers), you are the controller and we act as your processor. We will:

• process it only to provide, secure and support the Service and as you instruct through the Service;
• keep it confidential and limit access to people who need it to run the Service;
• use appropriate technical and organisational security measures;
• help you respond to requests from your clients about their personal data; and
• delete Customer Data within a reasonable time after your account ends, unless the law requires us to keep it.

5.3 You are responsible for having a lawful basis to collect your clients' personal data and enter it into PestFolio, for telling your clients how you use it (including that it is stored with a provider outside the UAE), and for who you give client portal access to.

5.4 We may use usage information about how the Service is used (for example which features are opened), stored without client names, contact details or report contents, to run and improve PestFolio. We may also use aggregated, anonymised data that cannot identify you or your clients to improve PestFolio and to produce industry statistics and benchmarks. Details are in our Privacy Policy.

6. Your responsibilities

6.1 You remain responsible for your pest control work and for meeting the rules that apply to it, including licensing, approved products, chemical handling and record-keeping required by Dubai Municipality or any other authority. PestFolio helps you keep records; it does not check that your work or records meet those rules.

6.2 You must not use the Service to break the law, send spam, upload harmful code, or try to access other customers' data or our systems without permission.

6.3 Reports and messages sent to your clients through PestFolio are sent on your instructions. You are responsible for their content and for having your clients' consent to receive them.

7. Service as is

7.1 We provide the Service "as is" and "as available". We work to keep it running and your data safe, but we do not promise that it will be uninterrupted or error-free, or that it will suit every purpose.

8. Liability

8.1 To the extent the law allows, we are not liable for any loss arising from your use of the Service.

8.2 Nothing in these Terms limits liability for fraud, wilful misconduct or gross error, or any other liability that cannot be limited under UAE law.

9. Suspension and ending the agreement

9.1 You can stop using PestFolio and close your account at any time.

9.2 We may suspend or close an account that breaches these Terms or puts the Service or other customers at risk. Where reasonable, we will warn you first and give you a chance to fix the problem. We may also suspend a paid account if fees are more than 14 days overdue after we have reminded you.

9.3 Sections 8 and 10 continue after the agreement ends.

10. General

10.1 Changes. We may update these Terms. We will tell you when we do. If you keep using PestFolio after a change, the updated Terms apply.

10.2 Governing law. These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction.

10.3 Language. If we provide these Terms in Arabic as well as English, the Arabic text prevails to the extent required by UAE law; otherwise the English text prevails.

10.4 Whole agreement. These Terms and our Privacy Policy are the whole agreement between us about the Service. If any part is found unenforceable, the rest stays in force.
